This website is operated by Frankly3DPrinting (ABN 41 994 586 903). Throughout the site, the terms “we”, “us” and “our” refer to Frankly3DPrinting. We provide this website, including all information, tools and Services available from this site to you, the user, conditional upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or making a purchase, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the site including browsers, vendors, customers, merchants and contributors of content.

Any new features or tools added to the store are subject to these Terms. You can review the latest version at any time on this page. We may update these Terms at any time by posting revisions. Your continued use after changes constitutes acceptance.

1. CONTRACT FORMATION

When you place an order on our website, you are making an offer to purchase. A binding contract is formed only when we:

  1. Issue an order confirmation,

  2. Begin preparing your order.

We may decline or cancel any order prior to acceptance.

2. ONLINE STORE TERMS

You represent that you are at least the age of majority in your state or territory of residence, or you have provided consent for your minor dependents to use this site.

You may not use our products for illegal or unauthorized purposes, nor violate any laws in your jurisdiction. Breach of these Terms may result in termination of Services.

3. GENERAL CONDITIONS

We reserve the right to refuse Service to anyone at any time.
Content (excluding credit card details) may be transferred unencrypted.
Credit card information is always encrypted during transfer.

You agree not to reproduce, copy, sell or exploit any part of the Service without written permission.

4. ACCURACY OF INFORMATION

Information on this site may not always be accurate, complete or current. Material is provided for general information only. You agree that you are responsible for monitoring changes.

5. PRICING, QUOTES & PAYMENT TERMS

All pricing is in AUD unless otherwise stated.

  1. Quotes and invoices are valid only for the stated period (e.g., 7 days).

  2. We may require full or partial upfront payment for custom, bulk or B2B work.

  3. Prices may be updated without notice.

  4. Pricing errors may be corrected at any time.

6. BULK DISCOUNTS & B2B TERMS

Bulk or wholesale pricing is discretionary. If payment terms are not met, discounted pricing may be revoked.

Separate written B2B pricing agreements may apply.

7. PRODUCTS & SERVICES

Colours, textures and appearances may vary due to display differences.
Some products or Services may be available exclusively online.
We may limit sales to individuals or regions at our discretion.

We do not guarantee that products or Services will meet your expectations except where required under the Australian Consumer Law (ACL).

8. BILLING & ACCOUNT INFORMATION

We may refuse or limit any order.
You agree to provide accurate, current, and complete billing and account information.

9. RETENTION OF TITLE (PPSA)

Title to Goods remains with Frankly3DPrinting until invoices for those Goods are paid in full. Until paid in full, customers must:

  1. Hold Goods as bailee

  2. Store Goods clearly identifiable as ours

  3. Not sell or transfer Goods without written consent

We may register a security interest under the Personal Property Securities Act 2009 (PPSA). You waive your right to receive certain PPSA notices.

10. RISK, DELIVERY & DAMAGE CLAIMS

Risk transfers upon delivery, pickup or collection, even if title has not passed.
We are not responsible for courier delays or third-party handling.
Claims for damage, shortage or incorrect supply must be submitted within 7 business days.

11. WARRANTY & AUSTRALIAN CONSUMER LAW

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to:

  1. A refund or replacement for major failures

  2. Repair for minor failures

  3. Compensation for reasonably foreseeable loss

Warranty exclusions apply to:

  1. Misuse or abuse

  2. Incorrect installation

  3. Improper storage

  4. Modification

  5. Normal wear

  6. Consumables (filament, resin, nozzles) except as required by the ACL

    Nothing in these Terms excludes your ACL rights.

12. CUSTOM WORK, CAD, ENGINEERING & MANUFACTURING

Custom or made-to-order work is non-refundable unless faulty under the ACL.
Engineering and CAD labour is billable even if full production does not proceed.
Default tolerances (unless otherwise quoted):

  1. FDM 3D printing: ±0.2–0.3 mm typical, up to ±0.5–1.0 mm on larger parts

  2. Resin printing: ±0.05–0.15 mm

  3. Machining: ±0.02–0.05 mm

13. CANCELLATIONS

Stocked items may be cancelled before dispatch.
Custom or special-order items cannot be cancelled.
We may cancel orders for non-payment or if supply becomes impractical.

14. LATE PAYMENTS & COST RECOVERY

Overdue invoices may incur:

  1. 10% annual interest (daily)

  2. Administrative fees

  3. Suspension of supply

You agree to pay reasonable debt recovery and legal costs.

15. OPTIONAL TOOLS

Third-party tools are provided “as-is”. Use is entirely at your discretion.

16. THIRD-PARTY LINKS

We are not responsible for the content or policies of third-party websites.

17. USER CONTENT

By submitting content, you grant us a non-exclusive right to use, copy, publish and distribute it. You may not submit unlawful, defamatory or harmful content.
We may remove content in violation of these Terms.

18. PERSONAL INFORMATION

Your personal information is handled in accordance with our Privacy Policy.

19. ERRORS & OMISSIONS

Errors and omissions may be corrected at any time.

20. PROHIBITED USES

You may not use the site for illegal, harmful, abusive or malicious purposes.

21. DISCLAIMER & LIMITATION OF LIABILITY

Except for your rights under the Australian Consumer Law:

  1. the Service is provided “as-is”

  2. we exclude liability for indirect, consequential or punitive damages

  3. liability is limited to the minimum extent permitted by law

22. INDEMNIFICATION (B2B CUSTOMERS ONLY)

Business customers indemnify Frankly3DPrinting for losses arising from:

  1. Breach of these Terms
  2. Misuse of products
  3. Unsafe installation or modification

This clause does not apply to consumers.

23. SEVERABILITY

Invalid provisions do not affect the remainder of the Terms.

24. TERMINATION

Either party may terminate. Obligations incurred before termination survive.

25. ENTIRE AGREEMENT

These Terms and linked policies form the entire agreement.

26. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia.
